The ABC claims these products contain 15.7% to 16.1% ethanol, exceeding the state's strict alcohol by volume (ABV) limits for unlicensed sales.

This enforcement action, which began with an investigation in September 2025 and culminated in raids on March 11, targets specific kratom extract formulations rather than kratom itself, which remains legal and unregulated in Kansas.

The timing of these seizures is particularly notable as a bill (SB497) that would classify kratom as a Schedule I substance just passed the Kansas Senate. A Schedule I designation would severely restrict kratom's availability and legality, moving it to illicit markets.
